These Terms and Conditions (“Terms”) apply to every visit to and use of the Omega Cookware website, and to every offer, order, and agreement concluded via our webshop.

APPLICABILITY AND SCOPE
2.1 These Terms apply to all legal relationships between Omega Cookware and the customer (“Customer”) arising from or relating to the use of our webshop and the placing of orders.
2.2 Deviations from these Terms are only valid if confirmed in writing by Omega Cookware.
2.3 If any provision of these Terms is null and void or is invalidated, the remaining provisions shall remain in full force and effect.
DEFINITIONS
Website/Webshop: the online store environment of Omega Cookware.
Customer: any natural person or legal entity who visits, uses the Website, or places an order.
Agreement: the purchase agreement between Omega Cookware and the Customer after acceptance of the order.
Product(s): all goods offered via the Webshop.
FORMATION OF THE AGREEMENT
4.1 All offers and product information on the Website are non-binding, unless explicitly stated otherwise.
4.2 The Agreement is formed at the moment Omega Cookware confirms the order (e.g., by email) or starts processing the order.
4.3 Omega Cookware reserves the right to refuse orders or request additional information, for example in cases of suspected fraud or abuse.
PRICES, PAYMENT AND INVOICING
5.1 All prices are displayed in the currency shown at checkout and are inclusive or exclusive of VAT depending on what is stated at checkout.
5.2 Any shipping costs and other surcharges will be clearly shown before the order is completed.
5.3 Payment is processed via the payment methods available at checkout. For details, we refer to our Payment Policy.
DELIVERY AND SHIPPING
6.1 Omega Cookware ships orders according to the processing times and delivery times described in our Shipping Policy.
6.2 Delivery times are indicative. Exceeding an indicative timeframe does not automatically entitle the Customer to compensation or cancellation, unless mandatory consumer law provides otherwise.
6.3 The risk of damage or loss transfers to the Customer at the time of delivery, unless otherwise determined by applicable law.
CANCELLATION, RETURNS AND REFUNDS
7.1 Cancellation is possible on a limited basis in accordance with our Cancellation Policy.
7.2 Returns and refunds are handled in accordance with our Return & Refund Policy.
7.3 Omega Cookware may refuse returns or issue (partial) refunds if the conditions set out in the Return Policy have not been met.
WARRANTY AND CONFORMITY
8.1 Omega Cookware warrants that the delivered Products conform to the Agreement, meet reasonable standards of quality and/or usability, and comply with statutory provisions.
8.2 Any (manufacturer’s) warranties apply without prejudice to the Customer’s statutory rights (such as conformity rights in consumer purchases).
8.3 Wear and tear, incorrect use, improper cleaning/maintenance, or damage caused by misuse is not covered by warranty.
LIABILITY
9.1 Omega Cookware is not liable for indirect damage, consequential damage, loss of profit, missed savings, or loss of data, unless there is intent or wilful recklessness.
9.2 To the extent Omega Cookware is liable, such liability is limited to the amount of the order to which the liability relates, or—if applicable—the amount paid out by the liability insurance.
9.3 Nothing in these Terms excludes liability that cannot be excluded or limited under mandatory law.
PRIVACY AND DATA PROTECTION
10.1 Omega Cookware processes personal data in accordance with applicable privacy laws (such as the GDPR).

INTELLECTUAL PROPERTY RIGHTS
11.1 All content on the Website (texts, photos, videos, logos, design and graphic elements) is owned by Omega Cookware or its licensors and is protected by intellectual property rights.
11.2 It is not permitted to copy, publish, distribute, or otherwise use (parts of) the Website or its content without prior written consent from Omega Cookware, except for strictly personal and non-commercial use.
FORCE MAJEURE
Omega Cookware is not required to fulfil any obligation if fulfilment is impossible due to force majeure, including (without limitation) disruptions at carriers, government measures, war, pandemics, strikes, fire, and failures in (tele)communications or payment systems.
APPLICABLE LAW AND DISPUTES
13.1 These Terms and all Agreements are governed by the laws of the United Kingdom.
13.2 Disputes should preferably be resolved by mutual consultation. If we cannot reach an agreement, the dispute may be submitted to the competent court in the United Kingdom, unless mandatory law designates another competent court.
